He also asked them to weigh in (non-binding) on whether or not they are copyrightable. See page three of the official jury slip. Ultimately he has to make the decision, so I'm not sure if this was a "see which way the wind is blowing" thing, or some sort of personal validity for the decision he was making.

Yes it does. The judge clearly stated that you can't just claim an infringement and ask for damages. You have to be demonstrate that the infringement was malicious or actually led to some sort of profit / competitive advantage.

Correct, the other important thing to point out is that the judge will be deciding on the "are APIs copyrightable?" question next week. He's making that call himself as a matter of law, but did ask the jury to weigh in on it. Oracle can appeal the shit out of his decision because the jury did not reach a unanimous decision when they weighed in - forcing the judge to decide on it.

I don't think he's making the claim that "napping" creates the productivity gain, I think he's saying "the policy" creates the productivity gain. Be it a nap, a 30 minute RC copter session, or general "my boss is a cool dude"-ness... he has seen x benefit since y date (where y = date the policy went into effect).

I'm about to drink this Hefeweisen (sic?). It's my first time drinking this kind of beer. What should I be looking for in terms of characteristics, flavours, body etc? I'd like to try brewing this style in the future. by frogger42in Homebrewing

  • Hints of banana or clove depending on the yeast used.

Yes - one of my buddies has been a conductor for about a decade now. He tells me stories like this all the time.

Suicides, stuck cars (that you later find out were empty), cows, deer... all the time. At first it really messed with his head but he's almost immune to it now.

You're conveniently ignoring the thousands of trades your 401(k) fund makes over the next 20 years to manage that portfolio for you.

The "Vanguard Super Awesome Fund (VSAF)" isn't a company, it's a portfolio being managed by Vanguard made up of tens (hundreds) of companies. They trade their interest those companies all day long, to grow your money.

If they get taxed on every one of those trades, that money comes out of your growth. It's not a 0.5% tax on initial 401(k) purchase and final 401(k) withdrawl... it's a 0.5% tax on every transaction. It's a compound interest problem, and it's going to amount to a lot of money out of your pocket over 30 or 40 years.

Is your 401(k) growing by at least 0.5% daily? Because there is a strong chance you'll be losing that much in growth.

By definition, tariffs are in place to penalize an industry. The U.S. applies a federal tariff to Chinese goods to promote U.S. goods.

My guess is the TN tariff is extraordinarily high to discourage gross consumption of Jack Daniels. If it was $5 a fifth, people would drink it like water... when it's $30 a fifth you slow their consumption down.

It's like tobacco taxes. Taxes take it up from $1 a pack wholesale to $8 a pack retail in an effort to discourage smoking.

As someone who used to co-manage a liquor store, state tariffs can be anywhere from 20% to 60% of the bottle price.

100% agree, and the management team attempted to make those very arguments (we've had a "partner in India" who augmented our staff for a few years - it was nothing but headaches for all of the aforementioned reasons).

The reality is, an accountant who doesn't understand how to build software and how to manage it long term just can't wrap his head around those counter-numbers. He sees cheap today, and thinks maintenance will be cheap too. I've watched it happen at countless companies.

Easier said then done. Sole earner for a three person household, so quitting without lining something up is out of the question. Plus it's a flyover state with not a lot of employers, so you have to wait for the right opportunity to open (if you want at least how much you're making).

I'd love to quit on principal - but it could be 3, 4, 6 months before I can line up a smooth transition.
